Massachusetts Landlord-Tenant Law Basics

Massachusetts limits security deposits to one month's rent. Landlords must also pay interest on the deposit annually and return it within 30 days of move-out (or within 30 days of receiving the tenant's forwarding address). Massachusetts also has strict rules about collecting "last month's rent" separately from the security deposit.

For nonpayment of rent, Massachusetts requires a 14-day written notice to quit before filing a summary process (eviction) case. For other lease violations or tenancy-at-will terminations, a 30-day notice to quit is typically required. Massachusetts Housing Court has strict procedural rules and landlords who fail to follow them may have their cases dismissed.

Massachusetts landlords must maintain rental units in compliance with the State Sanitary Code. Landlords must give at least 24 hours' notice before entering a rental unit for non-emergency purposes. Massachusetts law also requires landlords to provide tenants with a state-mandated booklet about tenant rights in certain circumstances.
