California Landlord-Tenant Law Basics

California limits security deposits to two months' rent for unfurnished units and three months for furnished units (for leases starting before AB 12 took effect). Under AB 12 (effective July 1, 2024), most new residential leases are capped at one month's rent for security deposits. Landlords must return deposits within 21 days of move-out with an itemized statement.

For nonpayment of rent, California requires a 3-day written notice to pay or quit. For lease violations, a 3-day notice to cure or quit applies. Eviction filings require strict compliance with notice content and service requirements, or judges will dismiss the case.

AB 1482 (Tenant Protection Act) imposes a statewide rent cap of 5% plus local CPI (max 10%) for most residential properties more than 15 years old. Many cities such as Los Angeles, San Francisco, Oakland, and others have their own stricter local rent control and just-cause eviction ordinances that supersede state law.
