Maryland Landlord-Tenant Law Basics

Maryland limits security deposits to two months' rent. Landlords must return the deposit within 45 days after the tenancy ends, along with an itemized statement of deductions. Maryland also requires landlords to pay interest on security deposits held for more than 6 months (at the rate set by the Secretary of Labor).

For nonpayment of rent, Maryland allows a landlord to file for eviction (called "Failure to Pay Rent") with only a written rent demand notice, there is no mandatory waiting period before filing. For other lease violations, the notice requirements vary. Montgomery County and Baltimore City have additional local protections that may apply.

Maryland landlords must maintain rental premises in a safe and sanitary condition. Reasonable advance notice (generally 24 hours) is required before entering a rental unit for non-emergency purposes. Maryland law prohibits landlord retaliation against tenants who exercise their legal rights.
