Under Delaware's Residential Landlord-Tenant Code, security deposits are limited to one month's rent for leases of one year or more. Landlords must return the deposit within 20 days after the tenant surrenders the unit, along with a written itemization of any deductions.
For nonpayment of rent, Delaware requires a 5-day written notice to quit before an eviction proceeding may be filed. For other lease violations, a 7-day notice to remedy or quit is required. Delaware evictions are handled in Justice of the Peace Court.
Delaware landlords must maintain rental units in a fit and habitable condition and must give at least 24 hours' notice before entering a rental property for non-emergency reasons.
