Why Idaho Landlords Choose LevelLandlord
Idaho Landlord Law at a Glance
Idaho does not have a statutory cap on security deposit amounts. Landlords must return the deposit within 21 days after the tenant vacates (30 days if the lease specifies), accompanied by an itemized written statement of any deductions. Failure to comply can result in forfeiture of deductions.
For nonpayment of rent, Idaho requires a 3-day written notice to pay or vacate before an eviction action can be filed. For other lease violations, a 3-day notice to cure or quit is required. Idaho handles evictions (unlawful detainer actions) in Magistrate Court.
Idaho landlords must maintain rental premises in a habitable condition meeting applicable housing codes. Landlords must give at least 24 hours' advance notice before entering a rental unit for non-emergency purposes.
