Florida does not cap the security deposit amount, but landlords must hold deposits in a separate account or post a surety bond. Deposits must be returned within 15 days after the tenant vacates (if no deductions) or within 30 days with written notice of claimed deductions. Failure to follow these rules can result in forfeiture of the right to deduct.
Florida requires a 3-day written notice to pay rent or vacate before an eviction can be filed for nonpayment. For other lease violations, a 7-day notice to remedy or quit is required. For certain incurable violations, a 7-day unconditional notice may be used.
Florida landlords must maintain the rental premises in a good state of repair, comply with housing codes, and must give tenants at least 12 hours' notice before entering except in emergencies.
